Please read these Terms and Conditions carefully before participating in ATXWD’s Exclusive Facebook Offer (“Offer”). By utilizing this Offer, you agree to be bound by these Terms and Conditions.
Offer Details
- Offer: This Offer is for the creation of a single sales funnel or landing page for the promotion of your product.
- Target Audience: This is an exclusive offer for Facebook users.
- Promoter: This Offer is provided by ATXWD (ATX WEB DEVELOPER), a marketing agency located in Austin, Texas.
Website Turnaround Time
- Standard Turnaround: ATXWD guarantees a 24-hour website turnaround time from the moment all required content and images are submitted by the client.
- Content Submission Requirement: The 24-hour turnaround time will only commence once ATXWD has received all necessary text content, images, branding guidelines, and any other relevant assets from the client.
- Content Creation by ATXWD: If ATXWD is required to provide or create any content (text, images, etc.) for the landing page, an additional 24 hours will be added to the standard turnaround time.
- Free Custom Logo Design: If the Offer includes a free custom logo design, an additional 24 hours will be added to the standard turnaround time to accommodate the design process.
Client Responsibilities
- Content and Image Submission: Clients are solely responsible for submitting all desired content (text, images, videos, etc.) and branding elements for their sales funnel or landing page in a timely manner.
- Accuracy of Information: Clients are responsible for ensuring the accuracy and legality of all content provided to ATXWD.
- Revisions: Minor revisions may be accommodated within the scope of the project. Extensive revisions or changes to the initial scope may incur additional work and extend the turnaround time.
- Timely Feedback: Clients agree to provide timely feedback and approvals during the development process to avoid delays.
Payment and Fees
- Payment: Payment for the Offer is required in full before the commencement of any work.
- Additional Services: Any services requested outside the scope of this Offer, including but not limited to additional pages, complex functionalities, or significant revisions, will be quoted separately and are subject to additional fees.
Intellectual Property
- Client Content: The client retains all intellectual property rights to the content and images provided to ATXWD.
- ATXWD Work Product: Upon full payment, ATXWD grants the client a non-exclusive, perpetual license to use the developed sales funnel or landing page. ATXWD retains the right to display the completed work in its portfolio for promotional purposes.
Disclaimer of Warranties
- ATXWD will make reasonable efforts to ensure the sales funnel or landing page functions as intended. However, ATXWD does not warrant that the website will be error-free or uninterrupted.
Limitation of Liability
- In no event shall ATXWD be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the sales funnel or landing page.
Governing Law
- These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
